Contracting entity - EUR / USD (other GCC and export)

For orders from other GCC countries or with factory shipping, the contracting entity may be the Moroccan manufacturer or the Spanish representative, depending on the country of delivery.

The billing company will be specified in the quotation.

Acceptance of terms

By using this website or placing an order, the buyer accepts these terms and conditions, which take precedence over any buyer's own terms.

The buyer confirms that all information provided is accurate, that they are familiar with the products' technical and aesthetic characteristics, and that they have the legal capacity to enter into this agreement.

The seller reserves the right to refuse any sale at any time and for any reason.

Prices

Prices are quoted in AED or USD.

All prices exclude transport, taxes, duties, handling, and other applicable charges.

A quotation will be provided to confirm full pricing and shipping conditions.

Minimum order quantities

Dubai stock: 5 m2 (approx. 50 sq ft).

Factory stock and production orders: 20 m2 (approx. 200 sq ft).

Special conditions may apply on certain products.

Payment

Stock orders are payable in full upon ordering.

A 50% deposit may be accepted on production orders, with the balance due prior to shipping.

Quotations are valid for 30 days, except those including air freight.

Manufacturing and logistics

All products are manufactured in Tangier (Morocco).

For Dubai stock orders within the UAE, delivery is arranged through a local logistics partner, who will contact you within 2 business days of order confirmation. Delivery within UAE typically takes 1-5 business days depending on destination.

For other GCC countries and international destinations, shipping is by land and/or sea freight using international logistics providers; incoterm conditions vary by destination. Clients may also collect Ex Works (EXW) at their own cost and responsibility.

Standard tiles are packed in cardboard boxes of 10-30 kg, palletised. Larger tiles or slabs are placed directly on a pallet.

Freight costs are time-sensitive and subject to change. Mosaic Factory cannot be held responsible for delays caused by weather, customs, vessel availability, or other circumstances beyond its control.

Delivery (Dubai stock and DAP/DDP conditions)

Delivery address must be accessible by a large delivery vehicle, kerbside delivery to a paved road only.

Unloading, pallet unpacking, and transportation to site or upper floors are not included.

Gated communities, special access requirements, or restrictions must be communicated in advance and may incur additional costs.

A specific delivery time slot cannot be confirmed.

Receipt of goods

Any visible damage must be noted on the proof of delivery and reported to customer service within 48 hours with photos.

Missing or incorrect items must also be reported within 48 hours.

Replacement tiles or a partial refund may be considered for incorrect product sent, incorrect quantity received, or damaged products.

Claims made after 48 hours or when shipping is organised by the client will not be accepted.

Returns

Returns are not accepted. All orders are final.

For defective or incorrect goods received, please refer to the Receipt of goods section above.

Storage costs

Dubai stock orders: free storage for up to 2 weeks after order confirmation; additional fees may apply thereafter.

Factory orders: after a grace period, a cost of $3 per calendar day per pallet may apply. Contact us by email for details.

Measurements and quantities

Mosaic Factory may assist with calculations, but the buyer is solely responsible for confirming measurements and total quantities on the order sheet.

Clients should verify quantities with their contractor.

An extra percentage is recommended for cutting waste, potential light damage, and tile selection.

Sales contract

The quotation from our customer service department acts as the sales contract and includes product details, quantities, financial, and shipping information.

Payment constitutes acceptance of the sales contract and these terms.

Product characteristics

Zellige, Terra, Terrazzo, Granito, and Hydraulic Mosaic tiles present natural variations in tone, texture, size, thickness, and finish due to their artisanal manufacturing process.

Each tile is unique. These characteristics are an integral part of the product and shall not be considered valid grounds for a return or refund.

Photographs, samples, and simulations are indicative only and are not contractually binding.

Verification before installation

The client is responsible for verifying the products before installation, in particular colours, dimensions, and quantities.

No claims or returns will be accepted once tiles have been installed, except in the case of a proven manufacturing defect not visible at the time of installation.

Products may present slight variations in dimensions, colour, thickness, or flatness. These tolerances are part of the normal characteristics of handmade products.

Limitation of liability

Installation and maintenance advice is provided for guidance only. Cutting, laying, and finishing of tiles must be carried out in accordance with professional standards and applicable regulations.

The seller's liability is strictly limited to the supply of products.

Mosaic Factory may assist with measurements, but the quantities confirmed on the order sheet are the sole responsibility of the buyer.

Intellectual property

Mosaic Decor Sarl is the owner of all intellectual and industrial property rights over the content and products shown on this website.

It is strictly prohibited to reproduce, make available to the public, or otherwise exploit any part of this website's content or design without prior written authorisation.

Limitation of liability

Mosaic Decor SARL is not responsible for damages of any kind arising from inaccuracies, errors, or omissions in the information on this website.

All communications sent by email to the address provided by the user are considered valid and effective.

The user is responsible for keeping their contact details up to date.

Personal data and storage

Customer data (excluding payment card details) is stored for the duration of the commercial relationship and for the purpose of reproducing products from previous orders.

Clients may request deletion of their data at any time by emailing info@mosaicdecor.net with subject "Delete personal data REQUEST".

Users may exercise their rights of access, rectification, and opposition at the same address.

Applicable law and jurisdiction

This legal notice is governed by Moroccan legislation.

Any disputes shall be submitted to the Courts and Tribunals of Tangier (Morocco), unless mandatory consumer protection laws applicable in the user's country of residence provide otherwise.

Payment processing

Online payments are processed through HiPay, a secure European payment platform with anti-fraud filters, complying with all applicable data security and payment protection regulations.
